Introduction
The 1984 Cash–Landrum federal complaint is one of the most important primary documents in the case, but it is often misunderstood. The complaint preserved the witnesses’ allegations in a formal legal filing, setting out exactly what Betty Cash, Vickie Landrum and Colby Landrum claimed had happened and why they believed the United States was legally responsible. It did not, however, establish that those allegations were true.
That distinction is fundamental. A civil complaint is the document that begins a lawsuit. It records what the plaintiffs assert and the legal remedy they seek. Whether those assertions become established facts depends on the evidence produced during litigation and any findings made by the court. In the Cash–Landrum case, the court never found that the reported craft existed, that the helicopters belonged to the federal government, or that the reported injuries were caused by a government operation. The complaint remains valuable because it documents, in precise legal language, what the plaintiffs alleged.
The filing asserted that:
- the United States owned and operated military CH-47-type helicopters;
- the government also operated an experimental hazardous aerial device;
- the operation of those aircraft caused the plaintiffs’ injuries;
- the government was legally liable under the Federal Tort Claims Act (FTCA); and

These statements are historically important because they show that the government-responsibility theory was part of the case from the outset rather than a later embellishment by UFO writers. What the complaint proves, therefore, is that these allegations were formally made in federal court by identifiable plaintiffs through legal counsel. It does not prove that the alleged aircraft existed or that the government’s responsibility had been established.
Why Pleadings Are Not Findings of Fact
One of the most common misunderstandings surrounding the Cash–Landrum case is treating the complaint itself as evidence that the encounter occurred exactly as described.
In American civil procedure, a complaint serves a different purpose. Under Rule 8 of the Federal Rules of Civil Procedure, it provides a “short and plain statement” explaining why the plaintiff believes relief is warranted. It is a pleading, not evidence. That distinction matters because the Cash–Landrum complaint contains numerous factual assertions, including claims about:
- the ownership of the helicopters;
- the existence of an experimental craft;
- the cause of the reported medical injuries; and
- government negligence.
Each of those assertions required evidential support. Filing them did not shift them into the category of judicially established facts.
Courts routinely accept complaints for filing without expressing any opinion about whether the allegations are true. The filing simply initiates the legal process.
The Burden of Proof Remained with the Plaintiffs
The lawsuit proceeded under the Federal Tort Claims Act, which allows certain claims against the United States for injuries caused by federal employees acting within the scope of their duties.
That legal framework imposed an important evidential requirement. It was not enough to show that something unusual had happened or even that serious injuries existed. The plaintiffs also had to demonstrate that the alleged conduct was attributable to the federal government.
This became the central evidential difficulty.
The witnesses consistently reported seeing numerous twin-rotor helicopters and believed they were military aircraft. However, identifying helicopters by appearance was not legally equivalent to proving federal ownership or operation. During the litigation, government agencies denied possessing the reported diamond-shaped craft and denied operating the helicopters involved in the alleged incident. As a result, one essential element of the claim remained unproven.
Which Claims Remained Unverified After Dismissal
The dismissal did not answer every question surrounding the incident. Instead, it left several major claims unresolved.
The court did not determine that:
- no unusual aerial object had been seen;
- the witnesses fabricated their account;
- the reported illnesses had another identified cause;
- the helicopters definitely did not exist; or
- every aspect of the witnesses’ testimony was false.
Equally, the court did not determine that:
- the object existed as described;
- the helicopters belonged to the United States;
- an experimental government programme operated the craft;
- radiation from the object caused the reported illnesses; or
- the plaintiffs had proved government negligence.

Why the Complaint Still Matters as Historical Evidence
Although the complaint did not prove the encounter, it remains one of the most significant documentary records in the Cash–Landrum case.
Unlike later retellings, books or documentaries, the complaint was created as part of formal litigation. It identifies the parties, sets out the precise legal theory, specifies the damages sought and records the plaintiffs’ contemporaneous assertions in a structured legal document. That makes it a valuable primary source for understanding what was actually claimed.
Its evidential value is therefore historical rather than conclusive. Researchers can rely on it to establish:
- what the witnesses alleged;
- when they made those allegations in court;
- the legal basis of their claim; and
- the specific acts of government responsibility they attempted to prove.
They cannot rely on the complaint alone as proof that the encounter occurred as alleged.
The Key Distinction
The Cash–Landrum complaint preserved the witnesses’ version of events in an official federal court record, giving later researchers an unusually detailed account of the claims behind one of the best-known UFO lawsuits.
What it did not do was transform those claims into established fact. Only evidence tested through litigation and accepted by the court could have accomplished that.
